Commission Staff Working Document on the Review of the E-Money directive (2000/46/EC)

A report by the Commission services which draws together the results of the evaluation process (the consultants' evaluation report, the public stakeholder consultation as well as a series of meetings with Member States) was sent to the Council and the European Parliament on 20th July 2006. The report contains recommendations about further steps for the revision of the E-Money Directive and in particular advocates integrating E-Money Institutions into the payment services Directive once adopted.

A consultation paper on the E-Money Directive

A broad ranging consultation paper on the E-money Directive (2000/46/EC) is published on the present website. This consultation will form an important part of the review of the E-Money Directive, also involving consultations with Member States as well as the commissioning of an independent study to be carried out by consultants.

The Commission intends to come forward with a report together with appropriate policy recommendations in Spring 2006. The consultation was opened to all stakeholders and closed on 14th October 2005.

A consultation paper on the treatment of mobile operators under the E-money Directive (closed)

A consultation paper on the treatment of mobile operators under the E-money Directive is published on the present website, considering the nature of pre-paid mobile phone cards.

According to Member States experts and the Commission services, pre-paid mobile phone cards are likely to be a form of electronic money when they are used to buy and pay third party products or services.

The present consultation aims at completing the legal analysis on the perimeter of the mobile operators' activity implying the issuance of e-money. It will also assess the impact of the current legal framework on the electronic communication sector. The Commission services consider that the E-money Directive must be applied in a proportionate manner. Therefore, comments should focus on practical and legal problems stemming from the application of the current rules and on the impact of a supplementary legal framework. The consultation paper seeks also advice on whether the Directive could be amended to better reflect industry needs and risks stemming from "hybrid" activities.

Although the document is mainly addressed at mobile operators, the Commission services welcome comments from connected industry (content providers, companies developing technology, other partners of mobile operators in the offer of additional product or services etc.), as well as consumers.

The comments received will be published on the present website, unless a specific request not to do so is received.

Follow-up of the consultation

Dg Internal market received around 60 replies from different stakeholders. These replies can be divided in the following categories: mobile operators, connected industry, payment services providers, e-money institutions, consultants, national administrations and sectoral associations.
